Class certification

The procedural threshold a class action must clear to proceed as a class rather than as a set of individual suits — requires common questions of law or fact, typicality, adequacy, and for damages classes, predominance and superiority under Rule 23. For home furnishings retailers, low per-customer dollar amounts may undercut the certification economics even when the underlying unjust-enrichment theory is plausible.
